Text Trivia Contest Rules
ROGERS WIRELESS / MABUHAY TEXT TRIVIA CONTEST RULES - TORONTO
The Rogers Wireless Mabuhay Text Trivia (the “Contest”) starts at 12:01am on July 13, 2009 and ends at 11:59pm July 18, 2009 (the “Contest Closing Date”), hereinafter defined as the “Contest Period”. All times are Eastern Standard Time. No purchase necessary.
This Contest is open only to residents over the age of 16 who are residents of the Greater Toronto Area and surrounding region (Oshawa through Burlington and north to Orillia within the telephone area codes 416, 647,289 and 905), except employees of Rogers Wireless Partnership (“Rogers”) and its parent and affiliated companies, representatives, dealers and agents, contest suppliers and judges, and those with whom they are domiciled. The Contest is subject to all applicable federal, provincial and municipal laws and regulations.
1. To enter the Contest, do any one or a combination of the following:
(a) Text Messaging. Send a text message containing the word ‘mabuhay’ using your Rogers Wireless device to short-code 111 during the Contest Period. This message will count as one (1) entry ballot into the Contest. Text messaging charges of $0.15 per message sent or according to your price plan will apply.
(b) No Purchase Entry. To enter without using one of the automatic entries described above, send a unique and original 50-word written essay entitled “How do you celebrate your Philippine heritage ?” together with your name, address and day/evening telephone numbers plus your age in an envelope with sufficient postage to the following address, to be received on or before the end of business day on the Contest Closing Date: Rogers Wireless Mabuhay Text Trivia, 8901 Woodbine Avenue, Suite 208, Markham, ON, Canada, L3R 9Y4. Each No Purchase entry will count as one (1) entry ballot into the Contest draw associated with your telephone area code. One (1) No purchase entry per envelope / per day /per person.
2. Prizes: Entrants are eligible to win one (1) of two (2) Samsung® Gravity™ having an approximate retail value of $199.99.
Phones do not include activation or airtime. Winner is responsible for all costs including but not limited to, the activation on the Rogers Wireless network. Winner must comply with Rogers Wireless Consumer’s Terms and Conditions and the user guide for the product and/or services. If winner is an existing Rogers Wireless customer, winner may transfer the phones to his existing Rogers Wireless line/account. No cash substitutes.
(a) Random draws will be made by a representative of Rogers on July 22, 2009 at approximately 10:00am from all eligible entries received during the Contest Period at the Rogers’ offices at One Mount Pleasant Road in Toronto, Ontario.
(b) Selected entrants will be contacted by telephone at the number listed on the entrant’s Rogers account or at the number from which the text message or download originated or at the number indicated on the No Purchase mail-in entry.
(c) If a selected entrant cannot be reached within five (5) days of the draw, incorrectly answers the skill-testing question, fails to return a Release of Liability as specified below, or declines the prize, he/she will be deemed to have forfeited his/her opportunity to win, and a new entrant will be chosen.
(d) Prizes must be accepted as awarded, and may not be transferred or exchanged in cash or otherwise. Rogers reserves the right, at its discretion, to cancel, terminate, modify or suspend part or in whole the Contest or to substitute a prize of at least equal value in the event of the unavailability, for whatever reason, of the advertised prizes.
3. To be declared a winner, selected entrants must first correctly answer, unaided, a time-limited, mathematical skill-testing question administrated at a mutually convenient time by text message or telephone and may also need to return a signed release of liability and acknowledgment form. In the event the selected entrant is a minor, the entrant’s parent or legal guardian will be deemed to be the entrant who must meet all Contest eligibility requirements and who may accept the prize on behalf of the minor. Contest judges’ rulings are final and without appeal in all matters related to the promotion and the awarding of prizes.
4. By entering this Contest, entrants consent to the use of their entry, name, city of residence and/or any photograph of or that may be taken in publicity carried out by Rogers and/or its advertising agencies, without further notice or compensation.
5. No communications will be entered into except with selected entrants.
6. Odds of winning depend on the number of eligible entries. All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the rules may be disqualified by Rogers. Rogers takes no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed entries, or for typographical or other production errors. Rogers is not responsible for any errors or omissions in printing or advertising this Contest. All entries become the property of Rogers and will not be returned.
7. Rogers is collecting personal data about entrants for the purpose of administering this Contest. Please see Rogers’ Privacy Policy at www.rogers.com for information on its policy towards maintaining the privacy and security of user information.
8. By entering this Contest, entrants release and hold harmless Rogers, its advertising and promotional agencies and the contest judge(s), their affiliates and respective directors, officers, owners, partners, employees, agents, dealers, representatives, successors and assigns (collectively the “Releasees”) from any liability in connection with this Contest or, if declared a winner, the prize. Before being declared a winner, entrants may be required to sign and return, within a stipulated period of time, a Declaration of Compliance with the Contest Rules and a full Liability and Publicity Release. By accepting a prize, winners consent to the use of their name, place of residence, voice, statements, photographs or other likenesses for publicity, advertising or informational purposes in any medium or format without further compensation or notice.
9. This Contest will be run in accordance with these rules, subject to amendment by Rogers. Entrants must comply with these rules, and will be deemed to have received and understood the rules by participating in the Contest. The terms of this Contest, as set out in these rules, are not subject to amendment or counter-offer, except as set out herein.
10. If the identity of an entrant is disputed (other than a No Purchase entrant), the authorized account holder of the Rogers Wireless account associated with the entry will be deemed to be the entrant. The individual assigned to the Rogers Wireless account associated with the entry will be considered the authorized account holder. A selected entrant may be required to provide proof of being the authorized account holder of the Rogers Wireless account associated with the selected entry. All entries (except for the No Purchase entries) must be submitted from a valid Rogers Wireless account. The sole determinant of time for the purposes of receipt of a valid entry (except for the No Purchase entries) in this Contest will be the Rogers network.
